1. Institution Date: 2005/06/08
2. Subject: A US enterprise, Power Integrations, filed
a complaint against System General on May 9, 2005,
supplemented on May 24, 2005, alleging violations
of section 337 of the Tariff Act of 1930. USITC has
voted to investigate the complaint.
3. Solution: To address the complaint.
4. Other issues: The complaint filed by Power Integrations
to USITC is substantially the same as a previous complaint
filed to US District Court, northern district of California
on 2004/06/28 by Power Integrations alleging patent
infringement.
In response to the investigation by USITC, System
General claims that:
(1) The investigation is substantially the same as
the previous complaint filed to US District Court,
northern district of California on 2004/06/28 by PI
alleging patent infringement.
(2) System General emphasizes its respect for Intellectual
Property Rights (IPRs). Moreover, System General’s
products are all covered by its own patents, and System
General has never infringed (nor ever had the possibility
to infringe) IPRs of other enterprises or violated
section 337 of the Tariff Act of 1930. Presently,
System General has been granted more than fifty (50)
patents in different countries, including thirty-six
US patents.
(3) System General is deliberating corresponding action
with legal consultants and will undertake action to
hold all customers’ rights and interests from
unreasonable harm.
